California AB 2424: How Bay Area Homeowners Can Postpone Foreclosure by Providing a Listing Agreement
If you are facing foreclosure in the Bay Area, California's AB 2424 may provide valuable additional time to sell your home and protect your equity before a foreclosure auction takes place.
Effective January 1, 2025, California Assembly Bill 2424 gives eligible homeowners the right to postpone a scheduled trustee sale by submitting a valid listing agreement with a licensed California real estate broker. This law was created to help homeowners avoid losing their property at foreclosure auction and instead market and sell their home through traditional real estate channels.
What Is California AB 2424?
AB 2424 amended California's nonjudicial foreclosure laws to provide additional protections for homeowners facing foreclosure. The law applies to residential properties containing four units or fewer that are being foreclosed through California's trustee sale process.
One of the most important provisions allows eligible homeowners to receive a mandatory 45 day postponement of a scheduled foreclosure sale by providing a qualifying listing agreement to the foreclosure trustee.
How the 45 Day Foreclosure Postponement Works
Under AB 2424, the foreclosure trustee must postpone the scheduled trustee sale for at least 45 days when a homeowner provides:
A valid listing agreement with a California licensed real estate broker
Proof the property will be marketed on a publicly available platform such as the MLS
The required documentation at least five business days before the scheduled foreclosure sale date
When all requirements are met, the trustee is required to postpone the sale.
Important Requirements Homeowners Must Follow
Use a Licensed California Realtor
The listing agreement must be with a licensed California real estate broker. Informal marketing efforts or private sale arrangements do not qualify.
Meet the Five Business Day Deadline
The trustee must receive all required documentation at least five business days before the scheduled foreclosure sale date.
Submit Documentation Properly
AB 2424 requires homeowners to follow specific delivery requirements when submitting documents to the foreclosure trustee.
One Time Postponement Benefit
The listing agreement postponement is generally available once per foreclosure action, making it important to act strategically and market the property effectively.
Can Homeowners Receive More Than 45 Days?
Yes.
After obtaining the initial 45 day postponement through a qualifying listing agreement, homeowners may qualify for an additional 45 day postponement if they enter into a bona fide purchase agreement and provide the required documentation before the rescheduled sale date.
This means AB 2424 may provide up to 90 additional days to complete a sale and preserve home equity.
Why AB 2424 Is Important for Bay Area Homeowners
Bay Area real estate values are among the highest in the country. Many homeowners facing foreclosure still have substantial equity in their homes. Unfortunately, a foreclosure auction can often result in the loss of opportunities that may have been available through a traditional sale.
AB 2424 gives homeowners in communities such as Brentwood, Antioch, Oakley, Discovery Bay, Concord, Walnut Creek, Pleasant Hill, Livermore, Dublin, San Ramon, Fremont, San Jose, Santa Clara, Sunnyvale, Mountain View, and surrounding Bay Area cities additional time to market their property and potentially sell for full market value.
For many homeowners, preserving equity can mean protecting years of financial investment and creating a smoother transition to their next chapter.
How a Bay Area Realtor Can Help
An experienced Bay Area Realtor can help homeowners:
Prepare a qualifying listing agreement
Market the property through the MLS and major real estate websites
Coordinate with the foreclosure trustee
Attract qualified buyers quickly
Negotiate offers and timelines
Maximize the property's market exposure
Because foreclosure deadlines are strict, homeowners should seek professional guidance as soon as possible after receiving a Notice of Trustee Sale.
Need Help With a Foreclosure Sale in the Bay Area?
If you have received a Notice of Trustee Sale or are concerned about an upcoming foreclosure date, it is important to act quickly. AB 2424 may provide additional time to sell your home and protect your equity, but strict deadlines apply.
